ZD Painters – Terms and Conditions of Service

These Terms and Conditions apply to all services provided by ZD Painters and form part of every quotation and agreement with the Client.
By accepting our written quotation and allowing works to commence, the Client agrees to be bound by these Terms and Conditions.

1. Written Quotation & Scope of Works

All works are carried out strictly in accordance with the written quotation provided.

Any services not expressly detailed within the quotation are excluded unless agreed in writing.

Verbal agreements are not binding unless confirmed in writing.

2. Project Duration & Delays

Estimated completion timeframes are provided in good faith.

Project duration may vary due to:

  • Drying times
  • Unforeseen surface conditions
  • Additional preparation requirements
  • Third-party trades working on-site
  • Restricted access
  • Weather conditions (where applicable)

ZD Painters shall not be liable for delays outside our reasonable control.

3. Client Responsibilities

The Client agrees to:

  • Provide clear and unrestricted access to the premises during agreed working hours
  • Remove personal belongings, valuables, electronics, curtains and fittings prior to commencement
  • Ensure work areas are free from obstruction

While reasonable care will be taken to protect remaining items, ZD Painters cannot accept liability for damage to or loss of items
not removed from the working area.

Any heavy lifting or additional assistance required will be discussed separately and may incur additional charges.

4. Surface Conditions & Additional Preparation

Where previously plastered, repaired, or existing surfaces require additional preparation beyond that stated in the quotation,
such works shall be treated as additional services.

This may include (but is not limited to):

  • Additional filling
  • Sanding
  • Skimming
  • Remedial plaster repairs
  • Treatment of staining or defects

The need for such preparation may only become apparent after commencement of works.

Any additional services will be identified, discussed, and quoted separately. Written approval will be required before proceeding.

If the Client declines to approve additional preparation required to achieve an improved finish, ZD Painters reserves the right to:

  • Proceed strictly in accordance with the original quoted scope,
  • Suspend works, or
  • Terminate the agreement.

In the event of suspension or termination under this clause, the Client remains liable for payment of all works completed and
materials used up to that date.

5. Variations & Additional Work

Any requested changes to the agreed scope must be confirmed in writing and may affect both price and completion time.

Work will not proceed to the next stage until payment for the previous stage has been received where stage payments apply.

6. Payment Terms

Payments must be made in accordance with the schedule stated within the written quotation.

Failure to make payment when due may result in suspension of works.

All completed work and materials supplied up to the point of suspension remain payable.

7. Inspection & Notification of Concerns

The Client is encouraged to inspect works during progress and upon completion.

Any concerns relating to workmanship must be raised in writing within 7 days of completion.

This allows any genuine issues to be assessed and addressed promptly.

8. Practical Completion

Final payment signifies practical completion and acceptance of the works as per the agreed scope outlined in the quotation.

9. Snagging

One snagging visit is included where items fall within the original agreed scope of works.

Additional snagging, or works outside the agreed scope, will be chargeable.

10. Materials

Where materials are supplied by the Client, ZD Painters cannot guarantee their performance, durability, or suitability.

We may provide advice on material selection; however responsibility for client-supplied materials remains with the Client.

11. Liability & Insurance

ZD Painters holds public liability insurance up to £2 million.

We shall not be liable for defects or damage arising from:

  • Normal wear and tear
  • Structural movement or settlement
  • Damp, moisture or water ingress
  • Pre-existing substrate defects
  • Client-supplied materials
  • Damage caused by third parties after completion
  • Failure to maintain painted surfaces appropriately
Note: Nothing in these Terms excludes or limits the Client’s statutory rights under applicable UK consumer law.

12. Termination

ZD Painters reserves the right to suspend or terminate works where:

  • Payment terms are not met
  • The Client requests works outside the agreed scope without approval
  • Safe access to the premises is not provided

In such cases, payment for all completed works and materials used remains due.

13. Acceptance of Terms

By accepting our quotation and allowing works to commence, the Client confirms acceptance of these Terms and Conditions.
